It has been almost five years since the government of India passed the Real Estate Regulatory Authority Act in 2016. A lot has happened since then. Many reforms were introduced and more are on the anvil! At the initial stage, only 52 out of the 92 sections were notified and the rest were enacted from 1st May 2017, of course with some degree of modification and amendments.
The act was enacted to introduce transparency and accountability in the home buying process, protect the interests of home buyers and real estate investors and help them to avoid fraudulent and disputed real estate properties. The act aims to mitigate the delays that usually take place in the project completion and project delivery process, address the concerns of all the stakeholders, especially the buyers, builders, and brokers and also boost the growth of the real estate industry in India.
Uttar Pradesh is one of the first states in India to follow in the footsteps of the central government. The state launched its own Real Estate Regulatory act on 1st may 2017, also known as UP RERA. Most of the concepts in the UP-RERA are borrowed from the central RERA act except in cases where few amendments were reintroduced either to drop or correct several clauses about the definition of ongoing projects and common areas, despite the dismay of common residential real estate buyers. However, the state government has also assured the common masses that it will surely come up with a more revised set of rules and regulations in the future so that the act becomes more infallible and consumer-friendly.
Ever since its inception, the UP-RERA has been acting as an ideal consumer redressal forum for disputed real estate cases in Uttar Pradesh. As of now, the authority has registered tens and thousands of complaints from several ends and tried to provide the best real estate solutions and advisories for the victims of any miss-led real estate projects.
